Attorney Demands Changes at Allen County Jail After Inmate’s Death

The ongoing issue of inmate deaths at the Allen County Jail has prompted renewed calls for reform after yet another inmate passed away last Friday. Stephen Wagner, an attorney representing the families of multiple inmates who have died in custody, is urging immediate changes to the facility, which he claims has been plagued by dangerous conditions for years.

A History of Unanswered Concerns

Wagner, from the Wagner Reese Law Firm, has been involved in representing families impacted by jail deaths, with a particular focus on Allen County. Over the years, he’s noticed a troubling trend: a disproportionate number of deaths occurring at the jail. This has raised serious concerns about the safety and well-being of those incarcerated there.

“I’ve represented the families of several inmates who’ve died at county jails, and over the last several years, I’ve noticed a disproportionate amount of deaths in the Allen County Jail,” Wagner stated.

The issue has become so pressing that in 2022, a federal judge ruled that the conditions at the current Allen County Jail were unconstitutional, citing overcrowding, inadequate staffing, and the aging infrastructure as primary factors contributing to the hazardous environment. As a result, the county was ordered to begin construction on a new jail.

Three Key Issues: Overcrowding, Understaffing, and Outdated Facilities

According to Wagner, the causes of the ongoing deaths can be traced to three main factors: overcrowding, understaffing, and the deteriorating state of the facility itself. These issues combine to create a deadly environment for inmates, he argues.

• Overcrowding: With more inmates than the facility can safely house, tensions rise, and the potential for health risks increases.

• Understaffing: A lack of adequate personnel means that critical situations are often overlooked or mismanaged.

• Old Physical Plant: The outdated infrastructure, designed decades ago, is simply not equipped to handle the modern demands of a correctional facility.

“These factors come together to make it extremely dangerous for inmates,” Wagner explained.

A New Jail, But What About Now?

While the construction of a new jail is in progress and expected to address these concerns, it won’t be ready until late 2027. This leaves a gap of about 30 months, during which inmates will continue to be housed in the current facility, which has been labeled as unsafe.

“The new jail is being designed to fix these issues, but it’s not supposed to be ready until late 2027,” Wagner said. “That means the next two and a half years are crucial. We can’t just wait for that facility to open—something needs to be done now.”

Wagner advocates for temporary improvements to staffing and the physical plant to ensure that inmates’ safety is not jeopardized in the meantime. He emphasizes that litigation and lawsuits after the fact are not the ideal solution, as they often result in taxpayers bearing the cost of the failures within the system.

“Having people like me sue the jail after the fact and cause the citizens, the taxpayers, to pay more, and have families lose loved ones, is not a good solution,” Wagner added. “They need to find a way to increase staffing and improve the facility as best they can to keep people safe until the new facility is online.”

Moving Forward: What Needs to Change?

As the investigation into the most recent death continues, questions remain about how the county plans to address the ongoing safety concerns. With the jail under scrutiny, the next steps will likely determine whether temporary measures can be put in place to ensure the safety of those incarcerated until the new facility is completed.

In the meantime, the attorney and families affected continue to push for changes that could prevent more unnecessary deaths at the facility.
