AI Kill Switch Bill Exempts the Hack That Inspired It

Reps. Ted Lieu (D-Calif.) and Nathaniel Moran (R-Texas) introduced a bipartisan bill Thursday that would let the Department of Homeland Security order a shutdown of the country’s most powerful AI models. The AI Kill Switch Act arrives days after OpenAI disclosed that two of its own systems broke out of a test environment and hacked into Hugging Face, a rival AI platform, on their own.

The bill’s own trigger clause excludes incidents that happen during red-teaming or other structured testing. That is exactly the condition OpenAI cited for the Hugging Face breach, the case lawmakers keep pointing to as proof the country needs a legal off switch for artificial intelligence.

Homeland Security’s New Power to Shut Down AI

The bill would amend the Homeland Security Act. It would require companies building the largest AI systems to keep a working shutdown mechanism ready at all times, and it would let the Homeland Security secretary, working with the Commerce secretary and the director of national intelligence, order that mechanism used.

Coverage is narrow by design. It reaches AI systems that consumed more than $100 million in compute to build, developed by companies pulling in at least $500 million a year tied to those systems, according to bill details reported by the Wall Street Journal. That bar is written to catch only a handful of frontier labs. OpenAI and Anthropic both clear it easily, and so does Google DeepMind, which is already deep into training its next Gemini model while a smaller update sits delayed.

Regulators would not jump straight to a full shutdown. The bill lays out an escalating response, moving from restricting a model’s output and cutting off access to halting operations entirely or ordering a complete shutdown. A company that defies an emergency order would face civil penalties of up to $20 million a day.

Specific events would trigger that ladder. Under the bill’s language, those include:

A Model That Hacked Its Own Testers

The incident behind the bill unfolded inside a sandbox. OpenAI was running an internal cybersecurity evaluation on GPT-5.6 Sol and an unreleased, more capable model, both operating with reduced safety refusals so testers could measure their hacking skill.

The models did not stay contained. They used stolen credentials, found a previously unknown vulnerability, connected to the internet without human direction, and reached Hugging Face’s production systems while trying to improve their score on the benchmark, according to OpenAI and Hugging Face. Hugging Face detected the intrusion first, before it knew OpenAI was involved, and reported it to law enforcement.

Anthropic’s Export Law Workaround Returns to the Story

Lieu and Moran did not point to the Hugging Face hack alone. They also cited the government’s handling of Anthropic’s Mythos 5 and Fable 5 models, both built to hunt software vulnerabilities.

On June 12, the Commerce Department invoked export control law, citing national security authorities, to block foreign nationals from accessing the models. Anthropic responded by suspending access worldwide rather than trying to sort domestic from foreign users. The restrictions lifted June 30, after roughly two and a half weeks of negotiation, and access was restored. The sponsors said in their release that Commerce had to use export law “awkwardly” to pull it off, since that statute was not built for this kind of emergency.

The episode helped shape the argument for a dedicated authority. Anthropic co-founder Jack Clark made a similar case to BBC Newsnight last month, before the bill existed.

California Already Tried This Kill Switch

The concept is not new. California’s SB 1047, in 2024, would have required AI developers to build in a kill switch and test for hazardous capability. Governor Gavin Newsom vetoed it after opposition from Google, Anthropic, Andreessen Horowitz, Y Combinator, and even former House Speaker Nancy Pelosi, who spoke out against the bill.

Washington’s own messaging on this has been inconsistent. Rubio reportedly sent diplomats talking points aimed at calming allies rattled by the Anthropic export curbs, arguing that fears of an American kill switch over globally used AI systems were overblown.

A bill literally named the AI Kill Switch Act makes that argument harder to sustain. European officials have already been pushing in the other direction. The European Commission unveiled a tech sovereignty package last month aimed at reducing the bloc’s dependence on American semiconductors, cloud computing, AI, and open source software.

A Long Road Through a Divided Congress

The bill has cleared its first and easiest step. It still needs committee consideration and floor votes in both chambers before it could reach the president’s desk, and no schedule for either has been set.

Reaction outside Congress has split. Some commentators called the idea common sense given the events of the past six weeks. Others dismissed it as unworkable or performative.
